D1TechCreative LLC provides integrated business infrastructure, including an all-in-one CRM platform, workflow and communication automation, high-performance websites, digital advertising strategy, and business process optimization. Specific deliverables, timelines, and fees for any engagement are defined in a separate proposal, order form, or service agreement, which controls if it conflicts with these Terms.
3. SMS / Text Messaging Terms
These messaging terms apply to the SMS program operated by D1TechCreative LLC and form part of these Terms.
Program: D1TechCreative LLC SMS notifications and customer care.
Consent: Express written opt-in required; never a condition of purchase.
Frequency: Varies — approximately 2–6 messages per month.
Cost: Message and data rates may apply. We do not charge for the messages themselves.
Opt-out: Reply STOP at any time. Help: Reply HELP.
3.1 How you opt in
You may opt in to receive text messages by checking the SMS consent checkbox on a form on our website (the box is never pre-checked and is optional), by providing written consent during client onboarding, or by sending us a text message first. By opting in, you confirm that you are the subscriber or the customary user of the mobile number provided and that you are authorized to approve charges that may result.

3.3 Message frequency and charges
Message frequency varies based on your interaction with us, and averages approximately 2–6 messages per month. Message and data rates may apply according to your mobile plan. D1TechCreative LLC does not charge a fee for participating in this messaging program.
3.4 How to opt out
You can cancel the SMS service at any time. Reply STOP to any message you receive from us. After you send STOP, we will send one confirmation message and then stop sending SMS messages to that number. If you want to rejoin, simply opt in again as described above and we will resume sending messages. You may also opt out by emailing support@d1techcreative.com or calling (888) 330-1434.

3.6 Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed. Supported carriers may change without notice. If you change or deactivate your mobile number, you agree to notify us so we do not send messages to a number that has been reassigned.
3.7 Privacy of your mobile information
No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for full details.
4. Form Submissions & Consent
When you submit a form on our website, you represent that the information you provide is accurate and that the phone number and email address are yours or that you are authorized to provide them. Submitting a form constitutes your consent for D1TechCreative LLC to contact you by phone and email about your inquiry. SMS consent is separate, optional, and collected only through the dedicated checkbox on our form. Consent to receive marketing communications is not a condition of purchasing any product or service.
5. Eligibility & Accounts
Where we provide access to a CRM account or other software, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
6. Acceptable Use
You agree not to use our website, services, or messaging systems to:
- Send unsolicited, unlawful, deceptive, or harassing communications;
- Upload contacts you do not have documented consent to message;
- Violate the TCPA, CAN-SPAM, carrier requirements, or any other applicable law or regulation;
- Infringe intellectual property or privacy rights of others;
- Introduce malware, attempt unauthorized access, or interfere with our systems.
If we provide you with messaging capabilities as part of a CRM engagement, you remain solely responsible for obtaining and documenting valid consent from every contact you message, and for complying with all applicable messaging laws and carrier policies.
7. Fees & Payment
Fees, billing frequency, and payment terms are set out in your proposal, order form, or service agreement. Unless otherwise stated, fees are due on receipt, are non-refundable once services have been performed, and exclude applicable taxes. Third-party platform, advertising, and messaging costs are billed separately or passed through at cost unless expressly included.
8. Intellectual Property
All content on this website — including text, graphics, logos, and software — is owned by or licensed to D1TechCreative LLC and is protected by intellectual property laws. You may not copy, reproduce, or distribute it without our written permission. Upon full payment, you own the final deliverables created specifically for you; we retain ownership of our underlying frameworks, templates, and know-how.
9. Third-Party Platforms
Our services may rely on third-party platforms and providers. Your use of those platforms is subject to their own terms and policies. We are not responsible for outages, changes, pricing, or policy decisions made by third-party providers.
10. Disclaimers
Our website and services are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific business results, revenue, lead volume, rankings, or advertising performance.
11. Limitation of Liability
To the maximum extent permitted by law, D1TechCreative LLC and its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our total aggregate liability arising out of or relating to these Terms or our services will not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.

14. Governing Law
